STANDARD TERMS AND CONDITIONS FOR COMPETITIONS.
- In these terms and conditions, unless the context otherwise requires, the following words and expressions shall bear the meanings assigned to them hereunder:
- Affiliate – means Amplify’s partners, directors, officers, employees, agents, representatives, stakeholders, promoters subsidiaries, co-promoters and sponsors of any competition;
- Amplify – Amplify Africa Proprietary Limited, Registration Number 2010/009647/07;
- Terms and Conditions – the terms and conditions set out in this document as may be amended from time to time.
- These are the standard terms and conditions for competitions conducted or promoted by or in association with Amplify and/or its Affiliates and your participation in the competition conducted or promoted by Amplify and/or its Affiliates constitutes your binding acceptance of these Terms and Conditions on behalf of yourself and any person with whom you may share a prize, in the event that you win a prize which is for you and one or more additional persons, (“your partner”).
- You hereby acknowledge that your participation in a competition is voluntary, and you shall be entitled to opt out of the competition.
- Further, your participation in the competition is subject to the following:-
- you providing Amplify and/or its Affiliates with your personal information;
- you granting consent to Amplify to contact you with advertising material and/or offerings made by Amplify and/or its Affiliates;
- by merely joining the competition does not entitle you and/or your partner to win any prizes in respect of any promotions and/or competition run by Amplify from time to time;
- Competition’s shall not be open to –
- Amplify’s directors, members, partners, agents, employees, and/or any affiliated companies, agencies, associates, partner and/or any suppliers of goods or services in connection with the competition; and
- the spouse, life partner, business partner or associate, or the natural or adopted parent, child, or sibling, of any of the persons specified in 5.1 above.
- The judges’ decision is final and no further correspondence will be entered into.
- Amplify is not responsible for any entries which are not received by Amplify and/or its Affiliates, whether timeously or at all, regardless of the cause thereof. Without limitation, Amplify is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer hardware or software failure or malfunction, traffic congestion (whether physical, or on the Internet, telephone lines or at any service provider, website or other device or medium), or any combination thereof, or any other technical or other problems.
- It is your responsibility, as a participant, to ensure that any information which you provide in respect of a promotional competition is accurate, complete and up to date.
- You may not participate in or win a competition if you have won a competition promoted by Amplify within the past ___ (___) months. You will be eligible to participate in a competition promoted by us after the expiry of ______ (____) months after the date on which you won the last competition.
- Any costs or expenses which you may incur other than in respect of those items specifically included in a prize are for your own account. Amplify will not be responsible for any costs or expenses which you, or your partner (if applicable), incur during and for purposes of your participation in a competition and your acceptance and/or use of a prize. Amplify will specify, in the rules, the total value of the prizes to be won, the nature of the prizes, and any cost to be borne by the participants of any specific promotional offer, if any.
- Amplify does not make any representations or give any warranties, whether expressly or implicitly, as to a prize, and in particular, but without limitation, makes no representations and gives no warranty that a prize, or any aspect thereof, will meet your, or, if applicable, your partner’s requirements, preferences, standards or expectations; or punctual.
- Prizes are not transferable and may not be deferred, changed or exchanged for any other item or cash.
- You may not obtain a prize if it is unlawful for Amplify to supply such a prize to you. If you do not qualify to receive such a prize, you will forfeit it.
- In the event that you win, you must possess whatever documents and permissions that may be required in order to take part in the competition or claim a prize.
- Should you be a participant in a competition to whom a prize is due, you will be notified by means of the contact details provided to Amplify by you. Amplify may require you to provide it, as the case may be, with additional information as may be reasonably required to process and facilitate your acceptance and/or use of a prize. You have ____ (________) days from notification by Amplify to collect or organise delivery of a prize unless otherwise stipulated in the rules for a specific competition.
- Should you be a participant in the competition to whom a prize is due and you fail to respond to the formal notification by Amplify within the time period specified in 15 above, or in the rules for the specific competition, as the case may be, then you shall forfeit such unclaimed prize and thereafter Amplify shall randomly select a replacement winner from the competition entries. Amplify shall notify the replacement winner of such effect as soon as reasonably practicable and the provisions of this clause 16 shall apply to the replacement winner in the event that he/she fails to respond to the aforesaid notification.
- To the full extent permissible by applicable law, Amplify its Affiliates and its third party suppliers, as the case may be, reserve the right to vary, postpone, suspend, or cancel the competition and any prizes, or any aspect thereof, without notice at any time, for any reason which Amplify and such suppliers deem reasonable in the circumstances. In the event of such variation, postponement, suspension or cancellation, you agree to waive any rights, interests and expectations that you may have in terms of the competition and acknowledge that you will have no recourse against Amplify, its Affiliates and/or its third party suppliers.
- You agree that your participation in the competition, and your acceptance and/or use of a prize, or any aspect thereof, is at your own risk.
- Should you be a participant to whom a prize is due, you consent to Amplify or its authorised agents to take, capture, record and/or use your name, voice, photographic images or video images for the purpose of marketing and publicity campaigns and all costs or expenses which you and/or your partner may incur in respect of any items (where applicable) shall be for your own account.
- Amplify and its Affiliates will not be responsible, and disclaim all liability, for any loss, liability, injury, expense or damage (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, which is suffered by your participation in the competition or the acceptance and/or use by you, or your partner (if applicable), of any prize, or by any action taken by Amplify or any of its Affiliates in accordance with the Terms and Conditions.
- These Terms and Conditions will be construed, interpreted and enforced in accordance with the applicable laws of the Republic of South Africa.
- Amplify reserves the right to amend these Terms and Conditions at any time and will publish same on its websites or make same available to participants on request.
- Amplify reserves its rights to cancel, vary, postpone or suspend the competition and any prizes and in the event of any such cancellation, variation, postponement or suspension you agree to waive any rights, interest and expectations that you may have in terms of the competition and hereby acknowledge that you shall have no recourse against Amplify and/or its Affiliates.
- Should you or your partner (if applicable) fail to comply with these Terms and Conditions then Amplify may, without prejudice to any other rights it may have in law:
- disqualify you from the competition and you will forfeit the prize (in the event that you have already won)
- hold you liable for any loss or damage, whether directly or indirectly, incurred by Amplify as a result of your non-compliance, including all itsz legal costs (including attorney and own client costs) which may be incurred in taking any steps pursuant to your (or your partner’s) non-compliance.
- In the event that any of the terms of these Terms and Conditions are found to be invalid, unlawful or unenforceable, such terms will be severable from the remaining terms of these Terms and Conditions, which will continue to be valid and enforceable
